The National Human Rights Commission (CNDH) "evidenced" the responsibility of the State Police of Oaxaca in at least three civilian deaths during the operation carried out in Nochixtlán and other points of Oaxaca on June 19, 2016.

The operation began to evict a highway blockade in Asunción de Nochixtlán, Oaxaca, but extended to Huitzo, Hacienda Blanca and Viguera. It lasted 12 hours and had a total of seven people killed by gunshot wounds, all of them civilians, and was described by the president of the CNDH, Luis Raúl González Pérez, as "an example of what should not be police actions of this nature ".

On Wednesday, the CNDH issued recommendation 7VG / 2017, where it was confirmed that the Federal Police, the Gendarmerie, the Public Security Secretariat of Oaxaca, the State Police and the State Investigations Agency committed serious violations of human rights.

Regarding the seven people killed, the CNDH found the following:


The first three dead


Three died in Nochixtlán after receiving shots between 9:00 am and 10:00 p.m. on Robles Street in the hotel zone, and at least two of them were injured by 9 mm caliber bullets. and .223, the same of the arms that carried police state; in one case ballistic elements could not be recovered.

In addition, in the case of one of the victims, not only was it accredited that he was injured by bullets of the caliber used by state police that day, but that a person saw a state police shoot him in the head.

With these elements and a photograph showing the agents in the place of the facts, the CNDH accredited that there were state police armed and firing, that the policemen were located in the same zone and hour in which the three victims were injured by gun of concluding that, "there is a high probability that the death" of a victim "would be attributable to the State Police."


Three dead in "the nopalera"


Three more people lost their lives in Nochixtlán between 11:00 and 11:30 hours, during a second confrontation in the area known as "la nopalera" by the CNDH. Ballistic elements could only be recovered from two of these victims, and these were long arms of caliber .223 or 5.56 × 45 mm, ie the same caliber used by the State Police and the Gendarmerie respectively.

In addition, the CNDH obtained a video published in the media where three uniformed policemen are observed, two of them carrying long arms. The policeman who appears in the foreground comments "the güey ... is there sheltered ... you can see the head", later a policeman is observed lifting his long gun and a detonation is heard.

Moments later, other policemen are observed pointing their long guns while listening "to the red one!", Detonations are heard and the shout of "the one of red!" Is repeated, until a voice of smaller volume says "already fell the Red".

According to the CNDH, the video shows that at least two police officers fired their long arms; one of them was identified by name and position by the Secretary of Public Security of Oaxaca as an element of the State Highway Police.

The coincidences between the sayings of the police in the video and testimonies obtained by the CNDH, as well as the red dress of one of the victims, among other elements, "indicia of the individual responsibility of the death of both victims by the uniformed ones, one of them state highway police ".

A dead in Viguera


At 16:50 hours an emergency police operation was ordered in Viguera, an hour's drive from Nochixtlán, to free the 135D highway and allow the passage of the convoy from the first operation.

At 19:00 hours the convoy from Nochixtlán and another that made an emergency operation in Huitzo (between Nochixtlán and Viguera) met in Viguera with the agents mobilized there. All together they unlocked the road.
